SHORT-TERM RENTAL AGREEMENT


Between Boutique Southern Tip Escapes (acting on behalf of blfStudios Pty LTD) (“Agent/Manager”) and the Renter (as named on the Booking Form)

1 DEFINITIONS
Capitalized terms used herein have the meanings given in the Booking Form. If there is any conflict between this Agreement and the Booking Form, the Booking Form prevails.

2 PARTIES
2.1 Agent/Manager: Boutique Southern Tip Escapes on behalf of blfStudios Pty LTD
2.2 Owner: The legal owner of the Property
2.3 Renter: The individual(s) named on the Booking Form

3 BOOKINGS & PAYMENTS
3.1 To secure a booking, Renter must pay a 50% non-refundable deposit with the completed Booking Form.
3.2 The remaining 50% balance is due 30 days before the Check-In Date.
3.3 All payments are in South African Rands (ZAR), free of bank charges.
3.4 If the balance is not received by the due date, Agent/Manager may treat the booking as cancelled.

4 CANCELLATION POLICY
4.1 The 50% deposit is strictly non-refundable.
4.2 If Renter cancels or shortens the stay after paying the balance, no refund will be made.
Agent/Manager may, at its discretion, refund any portion of the balance that it successfully re-books, less costs incurred.

5 CHECK-IN & CHECK-OUT
5.1 Check-In: between 14:00 and 16:00 on the Arrival Date (unless otherwise agreed in writing).
5.2 Check-Out: between 10:00 and 11:00 on the Departure Date (unless otherwise agreed in writing).
5.3 Late departure may incur additional charges to compensate for delayed turnovers.

6 HOUSE RULES
6.1 Occupancy: Only the persons named on the Booking Form may stay, with up to the allowed property occupancy as confirmed on the property listing and deposit invoice.
6.2 Quiet Hours: Strictly 23:00 to 07:00. Noise must be kept to a minimum.
6.3 No Parties: Absolutely no events or parties, and no gatherings beyond the agreed occupancy.
6.4 No Smoking or Pets: Smoking indoors and pets are strictly prohibited. Any breach entitles Agent/Manager to terminate the stay immediately and to charge for additional cleaning and/or damage.
6.5 Renter must ensure all guests comply. Any breach may lead to eviction without refund.

7 LIABILITY & INSURANCE
7.1 Renter uses the Property at their own risk. Agent/Manager and Owner disclaim liability for injury, loss, or damage to persons or property, except where caused by their gross negligence or willful misconduct.
7.2 Renter is strongly advised to procure comprehensive travel, health, and cancellation insurance.

8 DAMAGE & CLEANING LIABILITY
8.1 Renter is liable for all damage to the Property or its contents, however caused, by Renter or Renter’s guests.
8.2 Liability for Damage and Cleaning:

“Renter shall be strictly liable for and shall fully indemnify and hold harmless Agent/Manager and Owner against any and all costs, expenses, claims and liabilities arising from damage to the Property (including fixtures, fittings and landscaping) and any extraordinary cleaning incurred as a result of Renter or Renter’s guests’ acts or omissions, including but not limited to stains, burns or odours to linen, curtains, carpets, furnishings, upholstery, floors or walls. Such sums may be deducted from any security deposit or charged to Renter’s credit card on file, and Renter shall promptly pay any balance owing upon presentation of an invoice.”

8.3 Agent/Manager may inspect the Property upon Check-Out and charge Renter for any necessary repairs or cleaning.

9 FORCE MAJEURE
Neither party is liable for failure to perform obligations caused by circumstances beyond reasonable control, provided prompt notice is given and reasonable efforts to resume performance are made.

10 GOVERNING LAW
This Agreement is governed by the laws of South Africa and the parties submit to the exclusive jurisdiction of the South African courts.

11 PRIVACY
By signing, Renter consents to Agent/Manager’s collection and processing of personal data in accordance with Personal Data Protection Laws.
