1. Accommodation Services
Boutique Southern Tip Escapes acts as the booking and short-term rental manager for privately owned holiday accommodation.
Each property listing provides information regarding the accommodation, maximum occupancy, location, facilities, pricing, minimum stay requirements and other property-specific conditions.
Every reservation relates to a specific property and specific arrival and departure dates selected by the guest.
Availability remains subject to confirmation at the time of booking.
2. Prices and Currency
All prices displayed and payments processed by Boutique Southern Tip Escapes are in South African Rand (ZAR) unless expressly stated otherwise.
The total booking price will be displayed before payment and may include:
Accommodation charges
Cleaning fees
Any additional charges specifically disclosed before payment
Guests making international payments are responsible for any foreign exchange, international banking or transfer charges required to ensure that the full invoiced amount is received.
Boutique Southern Tip Escapes is currently not VAT registered, and VAT is therefore not separately charged unless this status changes and the guest is informed accordingly.
3. Booking and Payment
A reservation is only finally confirmed once:
the required payment has been successfully received; and
the guest has accepted the applicable Short-Term Rental Agreement and booking conditions.
Unless different terms are expressly stated for a particular booking:
50% of the booking value is payable when the booking is made.
The remaining 50% is payable no later than 7 days before arrival.
Bookings made within 7 days of arrival may require payment in full immediately.
Payments made through the website are processed securely by PayFast.
Boutique Southern Tip Escapes does not receive or store the guest's full debit or credit card details.
4. Cancellation and Refund Policy
Guests may cancel an advance reservation by notifying Boutique Southern Tip Escapes in writing.
Our standard cancellation policy is:
More than 60 days before arrival:
50% of amounts already paid will ordinarily be refundable.
60 days or less before arrival:
No automatic refund is payable. A reasonable cancellation charge may be applied having regard to the circumstances of the cancellation.
Where cancelled dates are successfully re-booked, Boutique Southern Tip Escapes may refund an additional portion of the amount received, less reasonable costs, payment charges and losses associated with the cancellation.
No refund is normally payable for:
no-shows;
voluntary early departure;
a reduction in the number of guests after arrival; or
unused nights after the stay has commenced,
unless required by applicable law.
Any cancellation charge will remain subject to the Consumer Protection Act 68 of 2008. The Act permits accommodation providers to charge a reasonable deposit and a reasonable cancellation fee, taking into consideration factors including the amount of notice given and the reasonable likelihood of finding another guest for the cancelled dates.
Nothing in this policy is intended to remove or limit any statutory right available to a consumer under South African law.
5. Refunds
Where a refund is approved, Boutique Southern Tip Escapes will process the refund to the original payment method wherever reasonably possible.
Refunds processed through PayFast will be handled in accordance with PayFast's refund procedures.
An approved refund will normally be initiated within 7 business days, although the time taken for the funds to reflect may depend on PayFast, the guest's bank, card issuer and, in the case of international payments, the relevant banking network.
The amount refunded cannot exceed the amount originally paid for the transaction.
The guest will receive confirmation when a refund has been processed.
PayFast itself requires merchants to provide evidence/confirmation of refunds and generally processes refunds back through the original transaction method.
6. Cancellation by Boutique Southern Tip Escapes
In the unusual event that the booked property becomes materially unavailable or uninhabitable for reasons outside the guest's control, Boutique Southern Tip Escapes will endeavour to offer suitable alternative accommodation of a reasonably comparable standard.
If a suitable alternative cannot be provided or is not accepted, the guest will be refunded the amount paid for accommodation that Boutique Southern Tip Escapes is unable to provide.
Boutique Southern Tip Escapes will not be responsible for consequential travel expenses or losses beyond the accommodation booking except where liability cannot lawfully be excluded.
Guests are strongly encouraged to obtain comprehensive travel and cancellation insurance.
7. Delivery / Fulfilment Policy
Boutique Southern Tip Escapes provides short-term accommodation services rather than physical goods. No products are shipped or delivered by courier.
For purposes of online payment and fulfilment, the purchased service is delivered as follows:
Booking confirmation:
Once the required payment has been received and the applicable rental agreement has been accepted, a booking confirmation will be provided electronically by email and/or WhatsApp.
Accommodation delivery:
The accommodation service is supplied at the booked property during the arrival and departure dates stated in the reservation confirmation.
Check-in:
Generally between 14:00 and 16:00 on the arrival date unless otherwise agreed in writing.
Check-out:
Generally between 10:00 and 11:00 on the departure date unless otherwise agreed in writing.
Property access information and relevant arrival instructions will be provided to the guest before check-in.
The booking confirmation constitutes confirmation of the guest's right to occupy the booked accommodation for the confirmed dates, subject to the Short-Term Rental Agreement and receipt of all amounts due.
8. Changes to a Booking
Requests to change dates, guest numbers or properties are subject to availability and approval by Boutique Southern Tip Escapes.
A change may result in a change in the booking price.
Bookings may not be transferred, assigned, resold or sublet without prior written approval.
9. Occupancy and Guest Responsibility
The number of overnight guests may not exceed the maximum occupancy of the property or the number agreed in the reservation.
The person making the booking accepts responsibility for the conduct of all guests and visitors associated with the reservation.
Parties, events and gatherings exceeding the agreed occupancy are prohibited unless specifically authorised in writing.
Property-specific house rules form part of the booking conditions.
10. Damage and Extraordinary Cleaning
Guests are responsible for reasonable costs arising from damage, breakage, loss or extraordinary cleaning caused by the guest, members of their party or visitors, excluding ordinary wear and tear.
Where such a charge is necessary, Boutique Southern Tip Escapes will provide reasonable details of the loss, damage or cleaning cost.
Payment through PayFast does not constitute unrestricted authority for Boutique Southern Tip Escapes to charge a guest's card at a later date without lawful authorisation.
11. Internet, Electricity, Water and Other Services
Holiday properties rely on utilities and third-party services including electricity, municipal water, internet and mobile telecommunications.
Although Boutique Southern Tip Escapes will make reasonable efforts to assist with material service interruptions, uninterrupted availability of third-party utilities cannot be guaranteed.
Temporary interruptions do not automatically entitle a guest to a refund unless required by applicable law or the interruption materially prevents the accommodation service from being supplied.
12. Payment Security
Online payments are processed by PayFast, a third-party payment service provider.
Payment-card information is entered into PayFast's secure payment environment and is not stored by Boutique Southern Tip Escapes.
Boutique Southern Tip Escapes uses reasonable technical and organisational measures to protect booking and personal information transmitted through its systems.
13. Privacy
Personal information supplied when making a booking is processed for purposes including:
booking administration;
payment processing;
guest communication;
check-in and accommodation management;
security and legal requirements; and
delivery of the booked accommodation service.
Personal information is processed in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and applicable South African law.
Information may be shared where reasonably necessary with property owners, payment providers, channel managers and service providers involved in delivering the booked stay.
Marketing consent is separate from acceptance of these booking Terms & Conditions.
14. Consumer Rights
Nothing in these Terms & Conditions is intended to exclude any right or remedy that may not lawfully be excluded under the Consumer Protection Act 68 of 2008 or other applicable South African law.
Consumers have a statutory right to cancel an advance reservation, although a supplier may impose a reasonable cancellation charge.
The general electronic-transaction cooling-off provisions under ECTA do not apply in the ordinary way to accommodation services booked for a specified date or period.
15. Short-Term Rental Agreement
Every direct booking is additionally subject to Boutique Southern Tip Escapes' Short-Term Rental Agreement.
Before proceeding to payment through the BSTE direct-booking system, the booking holder will be required to:
read the agreement;
acknowledge important cancellation, damage, safety and liability terms;
confirm acceptance; and
provide their name as an electronic signature.
The agreement applicable to the particular booking forms part of the contract between the guest and Boutique Southern Tip Escapes.
16. Governing Law
These Terms & Conditions and any accommodation booking made through Boutique Southern Tip Escapes are governed by the laws of the Republic of South Africa.
Nothing in this clause limits a consumer's statutory right to approach any competent consumer body, ombud, tribunal or court.
